1.1 Unless the Customer shall have notified EVERYTHING PC LTD in writing within 5 working days of the date of EVERYTHING PC LTD's invoice that the Products have not been received or that the Products were damaged then delivery shall be deemed to have taken place in accordance with the Contract and the Customer shall not be entitled to raise any claim of short or mis-shipment or damage to the Products.
1.2 The Customer shall upon receipt of the Products sign the delivery note (proof of delivery) and be responsible for complying with the applicable shipping requirements of EVERYTHING PC LTD and its carriers. The Customer’s sign-off on EVERYTHING PC LTD’s delivery shall be at carton level. EVERYTHING PC LTD shall be entitled to assume that any person who both reasonably appears and claims to have authority to accept delivery who signs a note in respect of the Products on behalf of the Customer does in fact have the authority.
1.3 Any dates quoted or scheduled for the delivery of Products are approximate only and EVERYTHING PC LTD shall not be liable for any delay in delivery of the Products howsoever caused.
1.4 Partial delivery is allowed unless otherwise mutually agreed by both parties. Failure by EVERYTHING PC LTD to deliver the rest of the Products shall not entitle the Customer to treat the order as a whole as repudiated.
1.5 The Customer shall bear all costs associated with the unjustified refusal of Products. If the refusal is made on the grounds that the order was wrongly placed (i.e. wrong product, wrong pricing, etc.) and the refusal is accepted by EVERYTHING PC LTD, EVERYTHING PC LTD reserves its right to charge accordingly additional fees for return transportation and administrative expenses related thereto, and original carriage costs will not be reimbursed.
2. WARRANTY
2.1 EVERYTHING PC LTD will add a further one year warranty to that offered by the manufacturer (where explicitly extended - see product description), subject to exclusions (see 2.2). This covers labour and parts subject to a limit of the value of the warrantied goods.
2.2 Exclusions from warranties include accidental and deliberate damage, theft, or use usuitable to the product warrantied as well as what could be deemed fair wear and tear. Excluded in particular is cosmetic damage, fading of colours, wear of computer keys, buttons etc from use as well as gradual reduction of capacity of batteries which by their nature degrade in performance over time and is normal. Malfunctioning software/operating system is excluded.
2.3 The cost of postage and packaging to/from us is excluded from the warranty. The loss of goods in transit will not be covered by EVERYTHING PC LTD. We will always return goods via an insured carrier requiring proof of delivery and as such would recommend the same practice is followed by our customers returning goods.
2.4 EVERYTHING PC LTD reserve the right to repair or replace at our descretion, subject to any statutory obligations.
2.5 Where goods are returned that are not faulty or the fault is not covered under warranty, we will charge at the prevailing labour rate at EVERYTHING PC LTD, for the time taken to assess the product and repackage it.
